By accessing or using the Kyvvu website (kyvvu.com), or by creating a self-service account on the Kyvvu platform, you agree to these Terms of Service. If you do not agree, please do not use our website or create an account.

Prohibited Use

5. Disclaimer of Warranties
THE WEBSITE AND SELF-SERVICE PLATFORM ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
We do not warrant that:
- The website or platform will be uninterrupted or error-free
- Defects will be corrected
- The website or platform is free from viruses or harmful components

6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Kyvvu BV shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of this website or a self-service account, including but not limited to:
- Loss of data or profits
- Business interruption
- Service interruptions
For website use and free-tier self-service accounts, our total liability shall not exceed €100. For paid self-service accounts, our total liability shall not exceed the fees paid by you in the three (3) months preceding the event giving rise to the claim. Liability for negotiated enterprise engagements is governed by the applicable License Agreement.

Information about Kyvvu products and services on this website is for general information only and does not constitute:
- A binding offer or contract
- Professional or legal advice
- A guarantee of product performance
Specific product terms are documented in separate agreements (pilot agreements, license agreements, etc.) or, for self-service accounts, in Section 16 below.

- Block access for violations of these terms
- Remove content at our discretion
- Suspend or terminate self-service accounts in accordance with Section 16
11. Governing Law and Jurisdiction
These Terms of Service are governed by Dutch law.
Any disputes shall be resolved in the competent courts of Amsterdam, Netherlands.
12. Severability
If any provision of these terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
13. Entire Agreement
These Terms of Service, together with our Privacy Policy and (where applicable) the Acceptable Use Policy referenced in Section 16, constitute the entire agreement regarding your use of the website and self-service accounts. For negotiated enterprise engagements, the applicable License Agreement and Order Form take precedence.

15. Product Terms
Note: Apart from the self-service account terms in Section 16, these website Terms of Service govern only your use of our website. Use of Kyvvu products and services in other contexts is governed by separate agreements:
- Pilot customers: Pilot Agreement
- Enterprise customers: License Agreement (with signed Order Form)
- Partners: Partner Agreement
- Resellers: Reseller Agreement
- Advisors: Advisor Agreement
If you are a customer or partner under one of these agreements, your product-specific agreement takes precedence over these website terms for matters related to product use.
16. Self-Service Account Terms
This section applies if you create an account on the Kyvvu platform via self-service signup (i.e. without a signed Order Form). It supplements the other sections of these Terms of Service.
16.1 Eligibility
You must be at least 18 years old and authorized to bind any organization on whose behalf you create an account. One account per organization, unless otherwise agreed in writing.
16.2 Free Tier
Free-tier accounts are provided at no charge for evaluation, prototyping and non-production use, subject to a hard cap of 1,000 Agent-Hours per calendar month. Once the cap is reached, governed agent activity may be paused until the next billing cycle or until you upgrade to a paid plan.
16.3 Paid Tier
Paid self-service accounts are billed on a usage basis at €0.05 per Agent-Hour, in arrears, on a monthly cycle. Fees are exclusive of VAT and other applicable taxes. Payment is due within thirty (30) days of invoice date.
For volume tiers, custom pricing, data residency commitments, custom contractual terms, or production deployments at scale, please contact sales@kyvvu.com to enter into a License Agreement.
16.4 Acceptable Use
Your use of the platform, and the conduct of any AI agents you govern with it, is subject to the Acceptable Use Policy (“AUP”). The AUP forms part of these Terms by reference. Violations of the AUP may result in suspension or termination of your account in accordance with the AUP and Section 16.7 below.
16.5 Data and Deployment
Where you deploy the Kyvvu platform on your own infrastructure (the default), agent and policy data remain on your systems and Kyvvu does not act as a processor of that data. Where Kyvvu hosts components on your behalf, the processing is governed by our Data Processing Agreement, available on request via privacy@kyvvu.com.
16.6 API Keys
API keys issued to your account are confidential. You are responsible for keeping them secure, not embedding them in client-side code or public repositories, and rotating them promptly on any suspected compromise. You are responsible for activity carried out using your API keys.
16.7 Suspension and Termination
You may close your self-service account at any time. Kyvvu may suspend or terminate a self-service account, with or without notice, for material or repeated breach of these Terms or the AUP, for non-payment of fees, or where required by law. Sections 3, 5, 6, 11 and 12 survive termination.
16.8 No SLA
Self-service accounts are provided without a service level agreement. Service levels for production use are available under a negotiated License Agreement.
16.9 Conversion to Enterprise Agreement
If you sign an Order Form under a Kyvvu License Agreement, that agreement governs your use of the platform from the Order Form effective date and supersedes this Section 16 for the engagement covered by the Order Form.
